PLEASE NOTE THIS PRODUCT\nWARRANTY ONLY APPLIES TO CUSTOMERS TO WHOM SALUS CONTROLS PLC DIRECTLY SUPPLY\nPRODUCTS. <\/o:p><\/span><\/p>

If you did buy your product\ndirectly from Screwfix you must contact them for the 1st<\/sup> year\nwarranty, then you can contact Salus in relation to any defects with your\nproduct for the next 4 years. <\/o:p><\/span><\/p>

Definitions:<\/span><\/o:p><\/span><\/p>

\u201cConditions<\/b>\u201d \u2013 Means\nthe terms and conditions of business of SALUS for the sale and purchase of the\nGoods as amended from time to time.<\/span>
\n<\/span>\u201cWarranty<\/b>\u201d \u2013 Means the warranty set out in\nthese clauses, which is given in addition to and subject to the Conditions.<\/span>
\n<\/span>\u201cCustomer<\/b>\u201d \u2013 Means the person, company, firm\nor supplier who purchases the Goods from SALUS during the course of its\nbusiness.<\/span>
\n<\/span>\u201cGoods<\/b>\u201d \u2013 Means the goods (or any part of\nthem) included within the table below which have been supplied to the Customer\nby SALUS to which this Warranty relates.<\/span>
\n<\/span>\u201cSALUS<\/b>\u201d \u2013 Means SALUS Controls PLC\n(registered in England and Wales with company number 05057362) whose registered\noffice address is at Units 8-10<\/span>
\n<\/span>Northfield Business Park, Forge Way, Parkgate,\nRotherham S60 1SD.<\/span>
\n<\/span>\u201cWarranty<\/b> Period<\/b>\u201d \u2013 Means the warranty\nperiod set out in the table below for each of the Goods, which begins to run\nfrom the date of delivery.<\/span><\/o:p><\/span><\/p>

1. Product Warranty<\/span><\/b><\/o:p><\/span><\/p>

1.1 SALUS warrants that on\ndelivery, and for the Warranty Period from the date of delivery, the Goods\nshall:<\/span>
\n<\/span>1.1.1 Conform in all material respects with their\ndescription; and<\/span>
\n<\/span>1.1.2 Be free from material defects in design,\nmaterial and workmanship;<\/span>
\n<\/span>1.1.3 Be of satisfactory quality (within the meaning\nof the Sale of Goods Act 1979); and<\/span>
\n<\/span>1.1.4 Be fit for any purpose held out by SALUS.<\/span>
\n<\/span>1.2 Subject to clause 1.3, if:<\/span>
\n<\/span>1.2.1 The Customer gives notice in writing to SALUS\nduring the Warranty Period and within a reasonable time of discovery that some\nor all of the Goods do not comply with the warranty set out in clause 1.1;<\/span>
\n<\/span>1.2.2 SALUS is given a reasonable opportunity of\nexamining such Goods; and<\/span>
\n<\/span>1.2.3 The Customer (when asked to do so by SALUS)\nreturns such Goods and proof of purchase, at the Customer\u2019s cost, to SALUS at\nthe following address:<\/span><\/o:p><\/span><\/p>

\n<\/span>Units 8-10<\/span>
\n<\/span>Northfield Business Park<\/span>
\n<\/span>Forge Way<\/span>
\n<\/span>Parkgate<\/span>
\n<\/span>Rotherham<\/span>
\n<\/span>S60 1SD<\/span><\/o:p><\/span><\/p>

SALUS shall, at its option,\nrepair or replace the defective Goods.<\/span><\/o:p><\/span><\/p>

1.3 SALUS shall not be\nliable for the Goods\u2019 failure to comply with the warranty set out in clause 1.1\nin any of the following events:<\/span>
\n<\/span>1.3.1 The Customer makes any further use of such\nGoods after giving notice in accordance with clause 1.2;<\/span>
\n<\/span>1.3.2 The defect arises because the Customer failed\nto follow SALUS\u2019 oral or written instructions as to the storage, commissioning,\ninstallation, use and maintenance of the Goods or (if there are none) good\ntrade practice regarding the same;<\/span>
\n<\/span>1.3.3 The Customer alters or repairs such Goods\nwithout the written consent of SALUS;<\/span>
\n<\/span>1.3.4 The defect arises as a result of fair wear and\ntear, wilful damage, negligence, or abnormal storage or working conditions; or<\/span>
\n<\/span>1.3.5 The Goods differ from their description as a\nresult of changes made to ensure they comply with applicable statutory or\nregulatory requirements.<\/span>
\n<\/span>1.4 This Warranty shall apply to any repaired or\nreplacement Goods supplied by SALUS.<\/span><\/o:p><\/span><\/p>

2. Limitation of Warranty\nand Liability<\/span><\/b>
\n<\/span>2.1 Nothing in this Warranty shall limit or exclude\nSALUS\u2019 liability for:<\/span>
\n<\/span>2.1.1 Death or personal injury caused by its\nnegligence, or the negligence of its employees, agents or subcontractors (as\napplicable);<\/span>
\n<\/span>2.1.2 Fraud or fraudulent misrepresentation;<\/span>
\n<\/span>2.1.3 Breach of the terms implied by section 12 of\nthe Sale of Goods Act 1979;<\/span>
\n<\/span>2.1.4 Defective products under the Consumer\nProtection Act 1987; or<\/span>
\n<\/span>2.1.5 Any matter in respect of which it would be\nunlawful for SALUS to exclude or restrict liability.<\/span>
\n<\/span>2.2 The terms implied by sections 13 to 15 of the\nSale of Goods Act 1979 are, to the fullest extent permitted by law, excluded\nfrom this Warranty.<\/span>
\n<\/span>2.3 Except as provided in this Warranty, SALUS shall\nhave no liability to the Customer in respect of the Goods\u2019 failure to comply\nwith the warranty set out in clause 1.1.<\/span>
\n<\/span>2.4 Subject to clause 2.1:<\/span>
\n<\/span>2.4.1 SALUS shall under no circumstances whatsoever\nbe liable to the Customer, whether in contract, tort (including negligence),\nbreach of statutory duty, or otherwise, for any loss of profit, or any indirect\nor consequential loss arising under or in connection with this Warranty; and<\/span>
\n<\/span>2.4.2 SALUS\u2019 total liability to the Customer in\nrespect of all other losses arising under or in connection with this Warranty,\nwhether in contract, tort (including negligence), breach of statutory duty, or\notherwise, shall in no circumstances exceed the price of the Goods to be\nreplaced under the Warranty.<\/span><\/o:p><\/span><\/p>

2.5 Assignment and other\ndealings.<\/span><\/b>
\n<\/span>2.5.1 SALUS may at any time assign, transfer,\nmortgage, charge, subcontract or deal in any other manner with all or any of\nits rights or obligations under this Warranty.<\/span>
\n<\/span>2.5.2 The Customer may not at any time assign,\ntransfer, mortgage, charge, subcontract, declare a trust over or deal in any\nother manner with any or all of its rights or obligations under this Warranty.<\/span><\/o:p><\/span><\/p>

\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n\n<\/p>

3. General<\/span><\/b>
\n<\/span>3.1 If there is any inconsistency between the\ncontents of this Warranty and the contents of the Conditions, the terms of this\nWarranty shall prevail.<\/span><\/o:p><\/span><\/p>\n
